Miley Cyrus sued over Grammy-winning ‘Flowers’, accused of stealing from Bruno Mars’ song

Miley Cyrus is embroiled in a legal battle over the Grammy-winning song Flowers. On September 16, one of the world’s leading music investment platforms, Tempo Music Investments has filed a lawsuit against Miley Cyrus in the Los Angeles federal court. Parts of the popular song released in 2023 are allegedly taken from When I Was Your Man, an American singer Bruno Mars’ song that was released in 2013. Charges have also been laid against Michael Pollack and Gregory Hein as co-writers of Flowers. Among the companies now accused of distribution are Sony Music Publishing, Target, Walmart, Apple, and others. The lawsuit charges that Flowers made up of unauthorized “exploitation” of When I Was Your Man, reports a piece carried out by The Guardian. The lawsuit was claiming that with the combining and quantity of the similarities between the two recordings, one cannot deny that Flowers will not exist without When I Was Your Man. “With Flowers, Cyrus, Hein and Pollack have created a derivative work of When I Was Your Man without authorisation.”.

The litigant does not feature the name Bruno Mars. Tempo Music claims that the company owns a share of When I Was Your Man.Philip Lawrence sold the song to them. Tempo Music is suing Flowers for damages, the amount of which is currently undetermined. Flowers has accumulated the damages up to this point. The company is also suing for an injunction against Miley Cyrus. This injunction prevents Cyrus from making and distributing or even publicly performing the song.

Flowers is the first single from Miley Cyrus’ 2023 album Endless Summer Vacation.The track stayed at number one on the Billboard Hot 100 for eight weeks, breaking the record for the most weeks atop the chart and racking up over 1 million listens in a week on Spotify.

The suit was filed Monday by company Tempo Music Investments and was heard by a federal court in Los Angeles. It alleged that Flowers included unauthorized “exploitation” of the song. Co-writers Gregory Hein and Michael Pollack are also named, and Sony Music Publishing, Apple, Target, Walmart and other companies are accused for distributing the song.

Mars is not named as a plaintiff, though in its complaint, Tempo Music says it owns a piece of When I Was Your Man purchased from co-writer Philip Lawrence.

The Guardian contacted reps for Cyrus and Mars for comment.

Tempo Music is seeking unspecified damages plus to permanently enjoin Cyrus from reproducing, distributing or publicly performing the song.

The lawsuit states: “Any observer of Bruno Mars’ When I Was Your Man will be aware that Miley Cyrus’s Flowers did not accomplish all of that on its own. Flowers copies many melodic, harmonic, and lyrical elements of When I Was Your Man, including the melodic pitch design and sequence of the verse, the linking bass line, certain bars of the chorus, certain theatrical music elements, lyric elements, and specific chord progressions.”

It continues: “It is incontestable based on the combined number of similarities between the two recordings that Flowers would not exist without When I Was Your Man. With Flowers, Cyrus, Hein and Pollack have created a derivative work of When I Was Your Man without authorization.”.

Flowers won Cyrus her first Grammy at this year’s ceremony, for best pop solo performance. The song spent eight weeks at No 1 in the US last year and 10 weeks in the UK.
